The packaging law in Spain

A new packaging law has been launched in Spain on 01.01.2023. Companies are obliged to register in the packaging register and declare the packaging placed on the market there. Household, industrial, commercial and retail packaging must be registered.

This also applies to companies based outside of Spain. They must register in the packaging register via an authorised representative and declare the packaging. A local tax number (NIF) and a digital certificate are also required.

Can Taxdoo and its partners help me with the application and registration process?

As this is not a specific VAT-related issue, we do not offer any service in this regard. Our local partners can support you directly with regards to the plastic tax, but not with the registration in the packaging register. If you are registered in Spain, you have a local tax number.

There are various providers in Germany and other countries that can help you to sign up for the packaging register and declare your packaging. The Chambers of Commerce for Spain also offer various services in this matter.

You can also apply for a digital certificate in Spain directly via the FNMT website. Instructions on how to do this can be found here. For the digital certificate, you need to provide a NIE (personal identification number). The NIE has to be applied for – in person – at a Spanish embassy or a Spanish consulate.
